Why We Focus on Men and Fathers
Resolving post-judgement problems can be challenging. However, after a divorce, situations may arise that require the help of a New Jersey post-judgment mediation lawyer. Mediation can be beneficial for finding a resolution to issues that arise after a post-divorce settlement.
When couples face troubles after a divorce settlement, our team at Shore 2 Shore Mediation is here to help. Mediation is a powerful tool that allows families to navigate complicated legal matters without having to set foot in a courtroom. Litigation can be costly. Mediation can save your family money and emotional strain by helping you resolve the issues at hand in a healthy, friendly manner more quickly.
Our mediation lawyer will meet with both parties in a private session to discuss the problem between them. The goal of mediation is to focus on finding solutions to the issues that arise after the entry of a judgment. An experienced New Jersey post-judgment mediation lawyer oversees the process, utilizing professional experience to help the parties reach a mutually agreeable resolution.
Engaging with the other party and allowing the mediator to assist can help you avoid costly and lengthy litigation. Through mediation, you are often able to compromise and come to a resolution regarding spousal support, child custody, parenting time, or any other issues that arise.
During mediation, you and the other party will work with an experienced and compassionate mediator who will help you discuss the issues and work toward a resolution. The number of mediation sessions necessary depends on the complexity of the issues and how well you and the other party work together to reach a mutually agreed-upon resolution.
Our trusted team at Shore 2 Shore Mediation is ready to aid you in resolving your family matter with dignity and respect. Typically, mediation sessions are informal, but structured conversations guided by our skilled team. During mediation, both parties are allowed the time to speak without interruption and can describe their individual goals in seeking a post-judgement modification.
Our lead mediator, Brad Micklin, will help both parties gain clarity on the issues and move toward an agreement that both parties find acceptable. Once a resolution is reached, he will then outline the changes for you in a revised order draft. This draft may then be turned over to both parties’ legal and/or financial counsel for review.
This draft memo will be reviewed to make sure it is in your child’s best interest if the modification pertains to child support or custody, and will ensure it is legally enforceable. Once the draft is approved, the final order will be prepared and filed by Mr. Micklin. Upon completion, it will be submitted to the Superior Court Chancery, Family Part for Essex County, which represents Nutley. The court will then move to approve the order as long as all parties are in agreement.
Most divorce or family law conflicts can be resolved through mediation, allowing all involved parties to avoid stressful and lengthy litigation processes. Parties can work in mediation to seek agreement on property division, alimony, and custody of minor children.
Mediation is a great resource for individuals who would like to reach a compromise in a timely fashion, with most mediations being completed in one to two sessions. Mediation also allows you the legal certainty that your agreement will be enforced through the courts.
When parents find themselves arguing over custody and visitation arrangements, mediation can be a productive avenue to pursue. Parents can benefit by working together to find arrangements that suit their individual needs and are in their child’s best interest. Hire a post-judgment mediation lawyer to help ease you through life’s transitions.
Our team at Shore 2 Shore Mediation will be at your side, advocating for you throughout the process. We will be there to coach you through mediation sessions by preparing a brief that will include relevant facts of your agreement, legal principles, and proposed resolutions to the problems you are facing.
With over 20 years of experience representing clients in New Jersey, we work with clients in Nutley, Montclair, and Saddle Brook. We have proven experience with post-judgment mediation, successfully helping our clients reach agreements that work for both parties and are legally sound.
Mediation is an excellent choice for many people as it is far more affordable than litigation. Most attorneys will charge an hourly rate, which can add up fast, especially if your issues can’t be resolved without litigation. Our mediator will approach your case with confidence and offer support while seeking a resolution in a fraction of the time it would take during court proceedings, saving your family time and money.
With a majority of divorce cases settled before trial, a large number of families return to court post-judgment to make modifications or enforcement, mostly regarding child custody, visitation, and support. A skilled mediator can offer guidance and, if a resolution is not reached, provide clear steps to help achieve a mutually agreeable solution.
In 2023, one-third of Americans who had been married reported that their first marriage ended in divorce. New Jersey actually has the second-lowest divorce rate in the U.S. at 5.16 per 1,000 women divorced.
Judgments following divorce often involve matters that still tie both partners together, like child support, child custody, and spousal support. As your lives change and evolve, your needs will change as well, requiring post-judgment modification.
Shore 2 Shore Mediation can help both parties revisit parenting time or custody agreements, adjust child support based on new financial realities, and modify spousal support to reflect career changes or retirement. We believe you deserve to have a voice while creating solutions that work for everyone in your family, especially your children.
If you are ready to embark on the path to achieving a resolution to your post-judgment orders, our New Jersey post-judgment mediation lawyers are here to aid you. Contact us today to speak with your skilled mediation team and take the first steps to creating a valuable change for your family.
